Terms of Service

1. Who we are

Kohapu is operated by Vorvar Technology LTDA, CNPJ 50.535.785/0001-75, Av. Paulista, 1106, Sala 01, Andar 16, Bela Vista, São Paulo, SP, 01310-914, Brazil ("Kohapu", "we", "us"). By creating an account or using Kohapu, you agree to these terms. If you use Kohapu on behalf of a business, you confirm you can accept them for that business. How we handle your personal data is described in our Privacy Policy.

2. What Kohapu does

Kohapu reads your brand profile and creates Instagram posts for you: carousels and single posts with AI-written text and AI-generated illustrations. You review each post and only the ones you approve are scheduled and published to the Instagram account you connect.

3. Your account

• You must be at least 18 years old.
• The information you give us must be accurate and you keep your login details to yourself.
• You are responsible for everything done through your account. If you notice access you didn't authorize, email us right away.

4. Connecting Instagram

Kohapu works with Instagram Professional accounts (Business or Creator) through Instagram's official API, using permissions you grant on Instagram's own screen. You can revoke that access at any time in your Instagram settings. Kohapu is not affiliated with or endorsed by Meta. Meta can change its API, limit features or restrict accounts on its own and we are not responsible for those decisions or for posts that fail because of them.

5. Free preview

During sign-up, Kohapu creates two sample posts at no cost so you can see the result before paying. The preview is available once per Instagram account. Creating new Kohapu accounts with the same Instagram account to get it again is not allowed.

6. Plans and payment

• Weekly: a single payment for 7 days of access. It does not renew.
• Monthly and Annual: subscriptions that renew automatically at the end of each period until you cancel.
• Prices are in US dollars and are charged by Stripe, our payment processor. We never see or store your full card details.
• You can schedule posts only within the period you have paid for. If your plan ends, posts scheduled after that date are not published; they stay saved and you can reschedule them after subscribing again.
• We may change prices. A new price never applies to a period you have already paid for and we will email you before it applies to a renewal.

7. Cancellation and refunds

You can cancel a subscription at any time in Settings. Cancelling stops the next renewal, and you keep access until the end of the period you have already paid for.

Refunds follow the consumer law that applies to you. If you are a consumer in Brazil, you can withdraw within 7 days of your purchase and get a full refund (Consumer Defense Code, art. 49). If you are a consumer in the European Union or the United Kingdom, that period is 14 days. To request a refund, email support@kohapu.com from your account's email address. Outside these cases, payments are not refundable.

8. AI-generated content and your approval

Text and illustrations are generated by AI and can contain mistakes. Nothing is published without your approval, so review each post before approving it. We don't guarantee that generated content is accurate, original or fit for a specific purpose and once you approve a post you are responsible for publishing it.

9. Ownership

You own the posts created for your brand and the materials you upload, such as product photos and your logo. You give us permission to store, process and publish them only to run Kohapu for you. We own the Kohapu software, templates, design and brand. If you send us suggestions, we can use them without any obligation to you.

10. Acceptable use

You may not use Kohapu to create or publish content that:

• is illegal, fraudulent or misleading;
• promotes hate, harassment, violence or discrimination;
• is sexual content involving minors or sexual content of any kind without consent;
• infringes someone else's copyright, trademark or privacy;
• breaks Instagram's rules.

You also may not try to get around plan limits, access other people's accounts or overload the service. We automatically check content and may refuse to generate or publish posts that break these rules.

11. Suspension and termination

We may suspend or close accounts that break these terms or put Kohapu, other users or Meta's platform at risk. In serious cases this can happen without prior notice. You can stop using Kohapu and ask us to delete your account at any time (see our Data Deletion page).

12. No guarantees

Kohapu is provided "as is". We work to keep it available and working well, but we don't guarantee it will be uninterrupted or error-free and we don't promise any result such as reach, followers or sales.

13. Limitation of liability

To the extent the law allows, our total liability for any claim related to Kohapu is limited to the amount you paid us in the 12 months before the claim and we are not liable for indirect damages such as lost profits. Nothing in these terms limits rights that consumer law gives you and that can't be waived.

14. Changes to these terms

If we make an important change to these terms, we will email you at least 30 days before it takes effect. If you don't agree with the change, you can cancel before then.

15. Governing law

These terms are governed by the laws of Brazil. Disputes will be handled in the courts of São Paulo, SP, Brazil. If you are a consumer, you can also bring a claim where you live, as consumer law allows. We'd always rather solve things directly first, so please email us.
